NOTICE UNDER THE PERSONAL DATA PROTECTION ACT 2010
The Personal Data Protection Act 2010 (the “Act”), which regulates the processing of personal data in commercial transactions, applies to KINETA Sdn. Bhd. (“our”, “us” or “we”). For the purpose of this written notice (“Notice”), the terms “personal data” and “processing” shall have the same meaning as prescribed in the Act.

- Registering as KINETA Charge Mobile Application user.
- communicating with you;
- providing our products and services to you;

- conducting internal activities;
- market surveys and trend analysis;
- providing you with information on products and services of our and our related corporations;
- providing you with information on products and services of our business partners;
- legitimate business activities;
- complying with any legal requirements; and
- such other purposes directly related to the foregoing.

- Your personal data is being or is to be collected from in Application registration form and Support section, also any other documents to collect information and providing service information.
- You may, by providing us with a notice in writing: (a) limit the processing of your personal data or request us to cease or not begin processing your personal data for purposes of direct marketing; and/or (b) withdraw your consent previously given to us (in full or in part) to the processing of your personal data, subject to any applicable legal restrictions and a reasonable duration of time for such notice/request to be effected. If you limit the processing or withdraw your consent to any or all use of your personal data, it may result in: (i) us being unable to continue to administer any arrangement or contractual relationship in place between you and us; (ii) us being unable to (continue to) perform any of our contractual obligations to you (if any); (iii) us being unable to process your personal data for any of the Purposes; and/or (iii) the termination of any arrangements/agreements/contracts between you and us, without any liability on our part (“Consequences”).

- you may, upon payment of a prescribed fee, make a data access request in writing to us; and
- we may refuse to comply with a data access request or a data correction request and shall, by notice in writing, inform you of our refusal and the reasons of our refusal.
- We disclose or may disclose your personal data to Government agency as instructed by Law, internal or external Auditor, Operator, for the Purposes.
- We may require your assistance if the personal data relating to other persons is required to process your personal data for the Purposes and you hereby agree to use your best endeavours to assist us when required.
- In the event that personal data of any third party is supplied by you to us, you shall ensure that such third party has read this Notice and consented to us collecting his/her personal data for any of the Purposes prior to the supply of his/her personal data to us.
- Where another person is providing/submitting any of your personal data to us, you agree that you have authorised the disclosure of your personal data to us and consented to the processing of your personal data by us in accordance with this Notice.
- It is obligatory that you supply us your registered Name, E-Mail, Address (collectively, “compulsory personal data”). If you fail to supply us the compulsory personal data, it may result in any of the Consequences (as specified in paragraph 5 above).
- We may transfer your personal data to a place outside Malaysia and you hereby give your consent to the transfer.
- You are responsible for ensuring that the information you provide us is accurate, complete, not misleading and is kept up to date.
- In the event of any inconsistency between the English version and the Bahasa Malaysia version of this Notice, the English version shall prevail over the Bahasa Malaysia version.

NOTIS DI BAWAH AKTA PERLINDUNGAN DATA PERIBADI 2010
Akta Perlindungan Data Peribadi 2010 (“Akta” tersebut) yang mengawal selia pemprosesan data peribadi dalam transaksi komersial, terpakai kepada KINETA Sd. Bhd. (“kami”). Untuk tujuan notis bertulis ini (“Notis”), terma- terma “data peribadi” dan “pemprosesan” mempunyai maksud yang sama seperti yang ditakrif dalam Akta tersebut.
- Notis ini bertujuan untuk memaklumkan kepada anda bahawa data peribadi anda sedang diproses oleh atau bagi pihak kami dan anda dengan ini memberikan persetujuan anda bagi pemprosesan data peribadi anda.
- Data peribadi anda termasuk Nama, Nombor Telefon, E-Mail, Alamat, Maklumat Kenderaan dan semua data peribadi lain kami sekali lagi kumpul daripada anda pada bila-bila masa kemudiannya.
- Data peribadi anda sedang atau akan dikumpulkan dan diproses selanjutnya untuk:
- Mendaftar sebagai pengguna peranti mudahalih KINETA Charge.
- berhubung dengan anda;
- memberikan produk dan perkhidmatan kami kepada anda;
- menjawab pertanyaan anda;
- melaksanakan kegiatan dalaman;
- tinjauan pasaran dan analisis kecenderungan;
- memberi anda maklumat tentang produk dan perkhidmatan kami dan perbadanan-perbadanan berkaitan kami;
- memberi anda maklumat tentang produk dan perkhidmatan rakan-rakan perniagaan kami;
- kegiatan-kegiatan perniagaan sah;
- memenuhi apa-apa kehendak undang-undang; dan
- maksud-maksud lain yang berhubungan secara langsung dengan yang tersebut di atas.

- Data peribadi anda sedang atau akan dikumpulkan daripada dalam peranti aplikasi dan Support, serta apa-apa boring mendapatkan maklumat untuk memberi perkhidmatan atau maklumat.
- Anda boleh, melalui notis bertulis: (a) menghadkan pemprosesan data peribadi anda atau untuk memberhentikan atau tidak memulakan pemprosesan data peribadi anda bagi maksud pemasaran langsung); dan/atau (b) menarik balik persetujuan anda (sepenuhnya atau sebahagian) terhadap pemprosesan data peribadi anda, tertakluk kepada keperluan undang-undang dan tempoh yang munasabah untuk memproses notis bertulis / permintaan anda. Sekiranya anda menghadkan atau memberhentikan persetujuan anda untuk memproses data peribadi anda secara sebahagian atau sepenuhnya, ini mungkin mengakibatkan: (i) ketidakupayaan pihak kami untuk memuktamadkan sebarang kontrak dan / atau perjanjian anda dengan pihak kami; (ii) ketidakupanyaan pihak kami untuk terus menunaikan kewajipan kontrak terhadap anda; dan / atau (iii) penamatan sebarang transaksi / perjanjian / kontrak yang dimeterai antara pihak anda dengan kami, tanpa liabiliti kepada pihak kami (”Akibat-akibat”)

- Anda boleh, apabila dibayar fi yang ditetapkan, membuat suatu permintaan mengakses data secara bertulis kepada kami; dan
- Kami boleh enggan mematuhi permintaan mengakses data atau permintaan pembetulan data dan hendaklah, melalui notis bertulis, memaklumkan anda mengenai keengganan tersebut dan sebab-sebab bagi keengganan tersebut.
- Kami menzahirkan atau boleh menzahirkan data peribadi anda kepada Badan Berkanun Kerajaan seperti termaktub undang-undang, Audit dalaman dan luaran, Operasi untuk Maksud-maksud tersebut.
- Kami mungkin memerlukan bantuan anda jika data peribadi yang berhubungan dengan orang lain dikehendaki untuk memproses data peribadi anda untuk Maksud-maksud tersebut dan anda dengan ini bersetuju untuk menggunakan usaha terbaik anda untuk membantu kami bila dikehendaki.
- Jika data peribadi pihak ketiga telah diberikan oleh anda kepada kami, anda hendaklah memastikan bahawa pihak ketiga tersebut telah membaca Notis ini dan bersetuju dengan pemprosesan data peribadinya untuk mana-mana Maksud sebelum memberikan data peribadinya kepada kami.
- Jika orang lain memberikan/mengemukakan data peribadi anda kepada kami, anda bersetuju bahawa anda telah memberi kebenaran untuk pemberian/pengemukaan data peribadi anda dan anda bersetuju dengan pemprosesan data peribadi anda oleh kami selaras dengan Notis ini.
- Ia adalah wajib untuk anda memberikan kepada Nama berdaftar, E-mel, Alamat anda (secara kolektif, “data peribadi wajib”). Kegagalan pihak anda untuk memberikan kami data peribadi wajib tersebut mungkin menyebabkan Akibat-akibat tertentu yang timbul (sepertimana tertera dalam perenggan 5).
- Kami boleh memindahkan data peribadi anda ke sesuatu tempat di luar Malaysia dan anda dengan ini memberikan persetujuan anda terhadap pemindahan tersebut.
- Anda bertanggungjawab untuk memastikan bahawa maklumat yang anda berikan kami adalah tepat, lengkap, tidak mengelirukan dan terkini.
- Sekiranya terdapat apa-apa konflik antara versi Bahasa Inggeris dan versi Bahasa Malaysia dalam Notis ini, versi Bahasa Inggeris akan mengatasi versi Bahasa Malaysia.
- Kami mungkin mengemaskini dan meminda Notis ini dari semasa ke semasa. Kami akan memaklumkan anda apa-apa pemindaan kepada Notis ini melalui pengumuman di laman web kami atau cara-cara lain yang sesuai. Apa-apa pemindaan kepada Notis ini akan berkuatkuasa setelah pemakluman tersebut.

- What is a wallbox? A wallbox is an additional charging unit that provides power at a higher rate than a standard three-pin plug socket.
- Is the 7.4kW or 22kW AC charger faster than my wall plug? A standard wall plug has an output of 2.3kW compared to a wallbox that has an output of 7.4kW, 11kW or 22kW.
- How long will it take to charge my EV? The actual charge time will depend on the speed of the charger, the battery size and the electrical architecture of the EVs battery. However, to get a rough idea, the charging time can be calculated as follows: For example:
- What is the difference between tethered and untethered cables? Tethered cables are cables which are permanently attached to your charging station whereas untethered cables are those that are detachable from the charging unit. Some AC charging stations in Malaysia are un-tethered (does not have a cable attached to the charger) and you would therefore need to use a detachable cable to charge from these AC chargers.
- Can my AC charger be placed outdoors? Chargers that are rated IP54 or higher can be placed outdoors.
- Are all KINETA AC chargers compatible to my Electric Vehicle?
Our chargers come with a Type 2 (AC Charger) or CCS2 (DC Charger) tethered cable and will therefore be compatible to any EV models with a Type 2/CCS2. A Type 2 or CCS2 connector is as follows:

CCS2 - I am a Sime Darby Motors customer. Can I purchase a wallbox without the installation? If you are purchasing a Sime Darby Motors EV Charging package, please refer to your sales consultant.
- How long is the AC charging cable port? Please refer to the product page for each AC Charger’s cable length
- How long is the product warranty? The length of the product warranty depends on the product purchased. Please refer to the product page for details.The warranty will start from the installation date of the product or the date of purchase (if only product is purchased).
- What does the product warranty cover?
KINETA covers any damage to the product except for any liability of direct or indirect damages due to:
- Damage, accident, or theft.
- Dirt, corrosions, rust, or stains.
- Flood, lightning, overvoltage, fire, and storm (acts of nature).
- Modifications, alterations, improper installation, improper testing, or repair attempts by the third-party/ unauthorized by KINETA.
- Non-compliance such as usage of unapproved parts or components, inappropriate use, and operations contrary to instructions issued by the manufacturer.
Installation
- What is included in the basic home installation package?
We have two types of home installation package as follows:

The two protection devices included in the installation is as follows:
- Miniature Circuit Breaker (MCB)- Automatically switches off the electrical circuit during an abnormal condition in the electrical network such as an overload. MCBs are used to prevent damage to the circuit or the electrical appliance.
- Residual Current Circuit Breaker (RCCB)- Used to trip the circuit during earth faults, earth leakage and during electric shocks by sensing an imbalance between the phase and neutral conductors. RCCBs are primarily meant for the safety of human beings.
- What is not included in the basic home installation package?
- Any additional cabling required that is above 5 meters
- Optional safety equipment such as an Isolator IP66 or surge protection devices
- Civil works such as hacking and concealing works, extensive make good repairs
- Interstate mobilization outside of Klang Valley
- Anything else not itemized in the home installation packages.
- How long does the installation usually take?
- Businesses/high-rise residential buildings have varying requirements depending on the planned layout. This will take a minimum of a day or more depending on complexity.
- For installations in homes such as bungalows, terrace houses, semi-detached houses etc, it can take a minimum of 4 hours up to a day (if the cabling works are below 20 meters)
- I live in a condominium and would like to use a shared EV charger. How will my building property manager know how much to charge me for the electricity used to charge my EV? An Energy Meter can be used to measure electricity usage and can be included with an additional fee upon request. Please contact our customer service executive for further details.
- Does KINETA install for customers outside of Klang Valley? Yes, however, there will be an additional interstate mobilization charge.
- How long is the installation warranty? We provide a one-year warranty on all of our installations starting from the date of installation.
- What is covered under the installation warranty?
KINETA will cover any damage to the product due to installation except for any liability of direct or indirect damages due to:
- Flood, lightning, overvoltage, storm and fire (acts of nature).
- Willful destruction or damage of property, or/and being moved from the original installation location.
- Modifications, alterations, improper installation, improper testing, or repair attempts by the third-party/ unauthorized installer. * Please refer warranty terms & conditions (will insert our website link).
Billing & Invoice
- When can I expect to receive my invoice?
You will receive your invoice for the product and the installation after payment is completed. This will be handed to you in either hard or soft copy form depending on your preference. - Does KINETA offer credit card installment plan?
Yes, we do offer credit card installments for Maybank credit card holders only. The installments can be made for a 6-month or 12-month period. - How do I make payment?

Will my wallbox be delivered to me?
We will deliver the wallbox to you if you purchase it with the installation package.If only the wallbox was purchased, we will post it to your location with additional postage fees, or you may pick up your Wallbox physically at our office Level 6, Block 1, Sime Darby Motors City, 6, Jalan PJU 1A/7, Ara Damansara, 47301 Petaling Jaya, Selangor. Please contact our customer service executive (+60 19-272 7759) to arrange the pick up.
- Can I obtain a refund on my wallbox?
If the wallbox has been purchased and installed, there will be no refunds.
If there is a problem with the product or installation, please contact our customer service help line and we will troubleshoot the issue for you.
Troubleshooting and Warranty
- What should I do if I am facing issues with the charger or if my electrical appliances keeps tripping after installing the EV charger?
Please contact our customer help line at +60 19-272 7759. Our troubleshooting team will diagnose the issue remotely and provide on-site support to restore services where required. - Will there be an additional charge for troubleshooting services if my wallbox has a problem and is still under warranty?
No, there will be no additional charge for wallbox and installations that are still within the warranty period.
